Marriage

For a marriage celebrated abroad to have legal effect in Italy, it must be registered with the competent Italian Municipality.

Marriage Certificates Issued in Malaysia

To register in Italy a marriage certificate issued in Malaysia, applicants must first submit their request by email to the Consular Office at ambkualalumpur.consolare@esteri.it, attaching the following documents:

  • the marriage registration form, duly completed and signed by both spouses;

  • for each spouse, a copy of the passport, limited to the pages showing the photograph and signature;

  • the original marriage certificate or original marriage extract (Cabutan) issued by the National Registration Department / Jabatan Pendaftaran Negara (JPN), duly legalised by the Malaysian Ministry of Foreign Affairs (Wisma Putra);

  • in the case of a religious marriage, an extract or duplicate of the marriage certificate issued by the relevant religious authority. Alternatively, applicants may use the original Lelaki/Perempuan marriage certificate for registration of the marriage. If it is not possible to obtain an extract or duplicate and the applicant does not wish to use the original Lelaki/Perempuan certificate, a certified true copy of the marriage certificate may be obtained from the same office that issued the original certificate.

The extract, duplicate, original certificate, or certified true copy, as applicable, must be duly legalized by the Malaysian Ministry of Foreign Affairs (Wisma Putra).

If the documentation is submitted correctly and in full, the applicants will receive an email confirming that the documentation intended for registration is complete and in order.

All documentation must be submitted in original form. Original certificates cannot be returned to the applicants, as they must be retained in the family file held in the archives of the Consular Office.

Certificates issued by countries other than Malaysia

Applicants who are registered with AIRE (Registry of Italians Residing Abroad) and reside within this consular jurisdiction may submit their marriage registration request to this Embassy.

For certificates issued by countries other than Malaysia, applicants are advised to obtain the information necessary to complete the required formalities, including apostille or legalization, depending on whether the country concerned has ratified the 1961 Hague Convention, by consulting the website of the competent Italian Embassy or Consulate.

Where certificates are accompanied by sworn translations – for example, documents issued in Brazil – the translations must not only be apostilled but must also clearly and legibly bear the wording “translation conforming to the original.” This declaration must be made by the same professional who carried out the translation.

Failure to comply with this requirement will result in the documents being deemed inadmissible and both the certificate and its translation being returned to the applicant, who will then be required to complete the necessary formalities before resubmitting the documentation.
